DOAR Litigation Consulting ("DOAR") is a company that provides electronic discovery consulting and related services regarding the management (preservation, collection, analysis, review and production) of information (in both electronically stored and paper form) to lawyers, law firms, corporations, and courts with pending or contemplated claims or litigation. This work may encompass the inspection, collection, and receipt of personal information from sources in the European Union ("EU") as well as transmission and/or transport of that data into the United States for analysis, processing, and presentation as evidence in legal proceedings. Some of this information may be considered sensitive and confidential data and it is the policy of DOAR to recognize the privacy of personal information from the Member States of the European Union and to protect this information in a manner consistent with the seven Safe Harbor principles (Notice, Choice, Onward Transfer, Access, Security, Data Integrity, and Enforcement). DOAR adheres to the Safe Harbor principles except where there is a conflicting or overriding legal obligation, or to the extent expressly permitted by any applicable law, rule, or regulation. This privacy policy may be amended from time to time to be consistent with the requirements of the Safe Harbor and DOAR will post any revised policy on this website.
DOAR Safe Harbor Principles
Definitions"Personal Information" or "Information" means information that (1) is transferred from the EU to the United States; (2) is recorded in any form; (3) is about, or pertains to a specific individual; and (4) can be linked to that individual.
"Sensitive Personal Information" means information about an individual's health or medical condition, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, or any information received from a third party who deems and notifies it as sensitive.
NoticeAs required DOAR shall inform any individual from the EU of the purpose for which it collects and uses Personal Information and the types and non-agent third parties to which DOAR discloses or may disclose that Information. EU Individuals can contact DOAR to determine the choices and means for limiting its use and disclosure.
ChoiceDOAR will offer individuals the opportunity to choose whether their Personal Information can be disclosed to a third party or to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. For Sensitive Personal Information, DOAR will give individuals the opportunity to affirmatively or explicitly consent to the disclosure of the information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual.
Onward TransferDOAR shall ensure that any third party for which Personal Information may be disclosed subscribes to the Safe Harbor Principles or are subject to law providing the same level of privacy protection as is required by the Principles and agree in writing to provide an adequate level of privacy protection.
AccessDOAR shall allow any EU individual access to their Personal Information and allow the individual to correct, amend, or delete inaccurate information, except where the burden or expense or providing access would be disproportionate to the risks to the privacy of the individual in the case in question or where the rights or persons other than the individual would be violated.
SecurityDOAR shall take reasonable steps to protect Information from loss, misuse and unauthorized access, disclosure, alteration and destruction.
Data IntegrityDOAR has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the Information from loss, misuse and unauthorized access, disclosure, alteration and destruction. DOAR cannot guarantee the security of EU Information on or transmitted via the Internet.
