For even the most astute jurors, the damages phase of a trial can provoke feelings of uncertainty and confusion. This is the reason that damages awards can be a real wild card in any civil litigation. DOAR's experienced researchers will help you address this problem by studying how jurors will receive the damages presentation in your case.
In each of our carefully designed damages studies, DOAR recruits a sample of mock jurors that closely matches the demographic breakdown of the real jury pool. These jurors will hear your presentations, as well as the plaintiff's arguments, to determine and validate the amount of damages.
After the jurors are exposed to the case information, they will participate in an Interactive Focus Group with a DOAR researcher. The results of the focus session will reveal jurors' general attitudes about the issues surrounding a damages assessment. And it will show how jurors go about determining the amount of damages to be awarded. The results will also identify additional information jurors will need to hear in order to better receive the damages presentation. This insight can help your team in several ways.
