Congratulations to our clients Bruce Baird, Ben Razi, Jon Dougherty, Andrew Leff and the rest of the Covington & Burling trial team in a rare defeat of the SDNY U.S. Attorney’s Office in a high-profile civil forfeiture case.
Following a seven day trial before Katherine Polk Failla, a Federal District of Manhattan jury reached a unanimous verdict in just three hours in favor of their client, Efans Trading Corporation. The government was seeking forfeiture of nearly $7 million in assets from Efans – including bank accounts and 47 vehicles seized at East Coast ports and China-bound vessels. The case was part of a larger crackdown by the government against the niche automobile export business.
Lead attorneys Bruce Baird and Ben Razi stated that the graphic depictions developed by DOAR in both the opening argument and summation were a key to persuading the jurors that the assets were not forfeitable. DOAR was pleased to assist the Covington & Burling team with the development of their graphics and presentation of evidence at trial.
