It’s not over at jury selection or at the openings. After working in the middle of hundreds of trials, we have seen that jury verdicts are more related to jurors’ connection to the witnesses than is usually understood. This is because each juror’s attention is heat-seeking and zeroes in on emotional and interpersonal connections and disconnections with witnesses.
Because of this, during the initial stages of litigation, DOAR assists trial teams to train and prepare witnesses for their deposition and trial testimony in order to learn how they will come across in the center of the trial. We then work outward with this information to create trial themes that ripple out from the witness testimony, and then base jury selection, openings and closings on these witness-based themes.
