Natixis Prevails in Complex ERISA Fiduciary Duty Case

Congratulations to Jamie Fleckner, Michael Isenman, David Rosenberg, Kate McKenney, and the rest of the Goodwin Procter trial team on their decisive victory for their client, Natixis Investment Managers, L.P., in a high-stakes ERISA class action brought by former employee Brian Waldner.

Following a two-week bench trial in the U.S. District Court for the District of Massachusetts, Judge Leo T. Sorokin ruled in favor of Natixis and its Retirement Committee on all counts. The Court held that the plaintiff failed to meet the burden of proof on claims alleging that the plan inappropriately favored proprietary investment options and retained underperforming funds without proper oversight or justification.

DOAR was proud to support the trial team with demonstrative development and evidence presentation throughout the proceedings.
